Welcome to Picasso Pictures and Promotions! We are delighted to provide you with our photo booth rental services. Please carefully review the following Terms of Service that outline the agreement between you and Picasso Pictures and Promotions regarding the use of our photo booth rental services. By booking Picasso Pictures and Promotions services, you acknowledge that you have read, understood, and agree to all terms.
Rental Agreement
Rental Period: The rental period begins at the agreed start time and ends at the agreed end time. Additional charges may apply for extending the rental period beyond the agreed time.
Booking Confirmation: Your booking is confirmed only after you have made the required payment and received a confirmation from us. We reserve the right to cancel or reschedule a booking if unforeseen circumstances arise, in which case a full refund will be provided.
Equipment Use: Our photo booth and related equipment shall be used solely for its intended purpose and in accordance with our instructions. Any damage caused due to misuse, neglect, or unintentional or intentional actions will be the responsibility of the customer and will incur additional charges. Additionally, you will be provided with 10, 15 or 20 premium PVC props. You will be charged $20 for each missing or damaged prop.
Payment and Cancellation
Payment: The rental fee and any applicable taxes are due in full 7 days prior to the event date.
Cancellation by Customer: In the event of cancellation, the following refund policy applies:
Your $200 booking deposit is non-refundable. The booking deposit must be paid at the time of booking to secure your date. The full payment, must be made 14 days prior to your event. If you request a cancellation (in writing) 30 days prior to the rental date and you paid in full, a partial refund may be provided at the discretion of Picasso Pictures and Promotions. For bookings with less than a 14-day notice, your booked event must be paid in full 7 days prior to the event date.
Cancellation by Picasso Pictures and Promotions: We reserve the right to cancel a booking due to unforeseen circumstances or if we believe the event may breach our policies or local laws. In such cases, a full refund will be provided.
Liability and Indemnity
Customer Responsibility: The customer is responsible for the conduct of all event participants using the photo booth. Any damage to the photo booth or other equipment caused by event participants will be the customer’s responsibility and will result in additional charges.
Liability: Picasso Pictures and Promotions shall not be held liable for any loss, damage, injury, or claims arising out of or related to the use of our services, equipment, or props. This includes but is not limited to any direct, indirect, incidental, or consequential damages.
Indemnity: The customer agrees to indemnify, defend, and hold harmless Picasso Pictures and Promotions, its employees, and agents from any claims, demands, damages, costs, and expenses arising from the customer’s use of our services.
Intellectual Property
Photo Rights: The customer retains all rights to the photos taken during the rental period. However, we reserve the right to use these photos for promotional purposes, including but not limited to our website, social media, and marketing materials.
Proprietary Materials: All materials provided by us, including but not limited to logos, designs, and software, remain our exclusive property. No part of these materials may be reproduced or used without our prior written consent.
Rescheduling
In the event that the customer requires a rescheduling of the booked service, Picasso Pictures and Promotions will make reasonable efforts to accommodate such requests, subject to availability. However, it is acknowledged by both parties that Picasso Pictures and Promotions may not be able to provide the services on the requested rescheduled date due to prior commitments or other limitations. In such cases, Picasso Pictures and Promotions reserves the right to provide alternative dates for the provision of services, or if no suitable alternative is available, to cancel the booking upon mutual agreement between both parties. Any fees or deposits paid by the customer shall be subject to the terms of cancellation outlined in this agreement which states non-refundable.
Miscellaneous
Entire Agreement: These Terms constitute the entire agreement between the customer and Picasso Pictures and Promotions regarding the use of our services and supersede any prior agreements or understandings.
By booking our photo booth rental services, you affirm that you have read, understood, and agreed to these Terms of Service. If you have any questions or concerns, please contact Picasso Pictures and Promotions 954-821-3839 for clarification.
I agree to the terms outlined in this contract. I hereby grant permission for the use of my image in photographs for any lawful purpose, including advertising, promotion, or editorial use, in any medium. I understand that I will not receive compensation for the use of my image and waive the right to inspect or approve the final product. I understand that I booked the booth for _____hours and any time over that amount with result in extra charges.
